You are entitled to receive a payment of penalties because you worked for SDS Industrial Servicio, a subcontractor of the companies MINO and BIW, at the Rivian factory in Normal, Illinois.

PAYMENT

In order to receive your payment, please fill out the Claim Form on this website. You have three payment options:

  1. Zelle. For this option, you need a domestic bank account in the United States.
  2. Venmo. For this option, you have to provide the phone number associated with your Venmo account.
  3. Wire transfer to your international bank account. For this option you have to provide the name of the bank, the CLABE number (which is 18 digits), and your mailing address. Note that there is a $4.50 fee for this type of transfer.
  4. Paypal. For this option you have to provide the email address associated with your PayPal account.
  5. Mastercard Prepaid Electronic Card. For this option you have to provide the email address you want to use with your prepaid card.

The claim form also asks for your social security number (SSN) or individual taxpayer identification number (ITIN). You are not required to provide an SSN or ITIN to receive a payment, but failing to provide an SSN or ITIN may affect the tax withholdings from your payment.

The first deadline to complete this form is October 15, 2022. If you complete this form by that date, you will receive your payment by October 30, 2022. The second deadline to complete this form is November 29, 2022. If you complete this form by that date, you will receive your payment by December 13, 2022. Please complete the form as soon as possible.

BACKGROUND

The Office of the Attorney General of Illinois brought a lawsuit against MINO, BIW, and SDS alleging that these companies failed to pay their employees at Rivian in accordance with Illinois law. MINO and BIW decided to settle the lawsuit and pay into a fund to compensate workers. MINO and BIW paid a total of $315,000 under the settlement in exchange for a release of claims against MINO and BIW under the Illinois Minimum Wage Law, 820 ILCS 105/1 et seq. This settlement amount, after deducting the costs of settlement administration, will be distributed among the SDS workers.

A court in Illinois has approved this settlement. Copies of the legal documents are available HERE. You are entitled to a payment based on the amount of hours you worked at the Rivian factory as set forth in the consent decree. You should not contact the court.
